Prop-Folio is a tool that helps you analyze real estate deals. It is for information only — it is not investment, financial, legal, or tax advice, and its estimates are not guarantees. Always do your own due diligence and consult professionals before making any real estate decision.
You must be 18 or older to use the app. Subscriptions and purchases are billed and refunded through Apple. The plain-English summary below is for convenience only; the full Terms govern your use of the Service.
1. Acceptance of these Terms
These Terms of Use ("Terms") form a legally binding agreement between you and Prop-Folio LLC ("Prop-Folio," "we," "us," or "our") governing your access to and use of the Prop-Folio mobile application and any related websites and services (collectively, the "Service").
By downloading, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that the information you provide is accurate and complete.
3. Your account
To use certain features you must create an account with a valid email address and password. You are responsible for safeguarding your credentials and for all activity that occurs under your account. You agree to notify us immediately at support@prop-folio.app of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.
4. License to use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use the App on Apple-branded devices that you own or control, solely for your personal or internal business use of evaluating real estate. This license is also subject to the Apple Media Services Terms and the Usage Rules in the Apple App Store Terms of Service.
5. Subscriptions, credits & payments
5.1 Subscriptions
Prop-Folio offers auto-renewing monthly subscriptions, currently "Standard" and "Pro." Pricing is shown in the App at the time of purchase in your local currency. Payment is charged to your Apple ID account at confirmation of purchase.
Your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription, and turn off auto-renewal, in Settings → Apple ID → Subscriptions on your device. Deleting the App does not cancel your subscription.
5.2 Credits
Importing a property consumes one credit. Each subscription tier includes a monthly credit allotment, and unused credits roll over while your subscription remains active. You may purchase additional credits in one-time packs ("Credit Packs"). Credit Packs are consumable in-app purchases that are consumed when used and are non-refundable except as required by Apple's policies or applicable law. Credits have no cash value, are not transferable, and expire if your subscription lapses.
5.3 Refunds
All purchases are processed by Apple. We do not directly process payments and generally cannot issue refunds. Refund requests are handled by Apple and are subject to Apple's policies; you may request a refund at reportaproblem.apple.com.
5.4 Price changes
We may change subscription prices and the features included in each tier. Where required, we will give you advance notice and, for price increases, the opportunity to cancel before the change takes effect, consistent with Apple's requirements.
6. Free trials & promotions
We may offer free trials or promotional offers, such as a free first month for new subscribers. Eligibility and terms are presented at the point of purchase and may vary by region and account history. Unless you cancel before the trial or promotional period ends, your subscription will automatically convert to a paid subscription at the then-current price. We may modify or discontinue promotional offers at any time.
7. Acceptable use
You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service, except to the extent this restriction is prohibited by applicable law.
- Use the Service to violate any law, regulation, or third-party right.
- Misrepresent your identity or impersonate any person or entity.
- Scrape, harvest, copy, or otherwise extract data from the Service in bulk, or use it to build a competing product or dataset.
- Resell, redistribute, or commercially exploit the Service or its data except as expressly permitted.
- Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure.
- Interfere with, disrupt, or place undue load on the integrity or performance of the Service.
8. Your content & data
You retain ownership of the information you enter into the Service, such as property assumptions, notes, and checklist items ("Your Content"). You grant Prop-Folio a limited, worldwide, royalty-free license to host, store, reproduce, process, and display Your Content solely as necessary to operate and improve the Service and to provide it to you. You are responsible for Your Content and represent that you have the rights necessary to provide it.
9. Intellectual property
The Service — including all software, models, scoring methodology, text, graphics, logos, and design — is owned by Prop-Folio or its licensors and is protected by intellectual property and other laws. Except for the license granted in Section 4, these Terms do not transfer any right, title, or interest in the Service to you. "Prop-Folio" and our logo are trademarks of Prop-Folio LLC; you may not use them without our prior written consent.
10. Not investment, financial, or legal advice
The Service provides informational analysis and scenario-modeling tools only. It does not provide, and nothing in the Service should be construed as, personalized investment, financial, real estate, legal, accounting, or tax advice. Prop-Folio is not a financial advisor, broker, dealer, real estate broker, appraiser, lender, or fiduciary, and no advisory or fiduciary relationship is created by your use of the Service.
The deal scores, metrics, rent estimates, after-repair values (ARV), and other outputs are illustrative calculations based on the assumptions you enter and on third-party data. They are not appraisals, investment recommendations, offers, or guarantees of any outcome. You should independently verify all data and consult qualified professionals — such as a licensed real estate agent, appraiser, attorney, accountant, and lender — before making any real estate or financial decision. You are solely responsible for your decisions and their results.
11. No guarantee of accuracy or results
Real estate analysis depends on assumptions and on third-party data that may be incomplete, outdated, or inaccurate. We do not warrant the accuracy, completeness, timeliness, or reliability of any data, estimate, or output provided through the Service, and actual results — including rents, values, costs, and returns — may differ materially from any estimate. Past performance and modeled projections are not indicative of future results.
12. Assumption of risk
Real estate investing involves substantial risk, including the potential loss of your entire investment. By using the Service, you acknowledge and accept these risks and agree that you use the Service, and make any resulting decisions, entirely at your own risk. Prop-Folio is not responsible for any investment, purchase, sale, renovation, financing, or other decision you make based on the Service.
13. Third-party services & data
The Service relies on third-party platforms and data providers for hosting, authentication, subscription management, property and rent data, and address/mapping. We do not control these third parties and are not responsible for their data, accuracy, availability, acts, or omissions. Your use of certain third-party services may be subject to their own terms and privacy policies.
14. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL DATA AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY DATA OR ESTIMATE WILL BE ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL PROP-FOLIO OR ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR INVESTMENT LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
16. Indemnification
You agree to indemnify, defend, and hold harmless Prop-Folio and its owners, affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, Your Content, your violation of these Terms, or your violation of any law or third-party right.
17. Termination
You may stop using the Service at any time and delete your account from the in-app Account screen. We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms, if we discontinue the Service, or as otherwise necessary to protect the Service or other users. Sections that by their nature should survive termination — including Sections 9 through 16 and 18 through 22 — will survive.
18. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Subject to Section 19, the state and federal courts located in Cook County, Illinois will have exclusive jurisdiction over any dispute not subject to arbitration, and you consent to personal jurisdiction and venue in those courts.
19. Dispute resolution & arbitration
Please read this section carefully — it affects how disputes are resolved. Except for small-claims matters and requests for injunctive relief to protect intellectual property, you and Prop-Folio agree to resolve any dispute arising out of or relating to these Terms or the Service through final and binding individual arbitration, rather than in court. Arbitration will be administered by a recognized arbitration provider under its consumer rules, and may take place in the county where you reside or by remote means.
Class-action waiver. You and Prop-Folio agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@prop-folio.app with the subject line "Arbitration Opt-Out" and your account email. If any portion of this Section is found unenforceable, the remainder will remain in effect, except that if the class-action waiver is found unenforceable, this entire Section will be void.
20. Apple-specific terms
These Terms are between you and Prop-Folio only, not with Apple, and Apple is not responsible for the Service or its content. Apple has no obligation to furnish any maintenance or support for the Service. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the Service, and Apple is not responsible for addressing any claims relating to the Service, including product-liability, legal-or-regulatory, or consumer-protection claims. In the event of any third-party claim that the Service infringes intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of that claim. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
21. Changes to these Terms
We may modify these Terms from time to time. When we make material changes, we will revise the "Last updated" date above and, where appropriate, notify you through the App or by email. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
22. General terms
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Prop-Folio regarding the Service and supersede any prior agreements. Severability. If any provision is held unenforceable, the remaining provisions remain in full effect. No waiver. Our failure to enforce any provision is not a waiver of it. Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
